Faculty Rights Tip of the Week: Notice of Pending Discipline

If you receive a “Notice of Pending Discipline” it’s important to contact your CFA representative immediately. The timelines articulated in Article 19 of our Contract (Procedures for Disciplinary Action) move very quickly.  

The process begins with the Notice of Pending Discipline, which comes from the University President (or his/her designee).

Within 10 days of the receipt of the Notice of Pending Discipline you have the right to review the facts with a “reviewing officer,” in a meeting referred to as a “Skelly Hearing”.

Within 15 days of the issuance of the Notice of Pending Discipline the Skelly Hearing/Review Officer must issue a report to the President.

Within 5 days of the receipt of this report, the President must notify the faculty member of his/her decision to rescind, modify, or affirm the pending disciplinary action.

After receiving the President’s decision, faculty have 10 days to appeal this decision as articulated in Article 19.10. (More on these options and what comes next in future Faculty Rights Tips.)

The entire process from the Notice of Impending Discipline until the time an appeal must be filed takes 30 days or less.  This is why it so important to contact your CFA representative immediately if you receive a Notice of Impending Discipline.
